Internal Memos Show Conflict on WOTUS

Internal memos released by the House Oversight and Government Reform Committee reveal the Army Corps of Engineers, the primary regulator in the EPA’s Waters of the U.S. rule, believes that the rule will not hold up in the courts and that it grossly misinterprets the Army Corps data. The National Cattlemen’s Beef Association along with the American Farm Bureau, is calling for immediate withdraw of the final WOTUS rule. Farm Bureau stated the documents also validate AFBF’s own concerns that the rule makes it impossible for anyone, including the Corps, to know which features on the landscape are regulated. Enforcement of the rule is set to begin August 28th. Multiple lawsuits have been filed against the EPA in an effort to stop the rule.
