Last Friday, an appeals court ordered a nationwide stay against the Waters of the U.S. (WOTUS) Rule. The three-judge panel for the U.S. Court of Appeals for the Sixth Judicial Circuit voted 2-1 to stay implementation over concerns that the rule may cause a burden to state and federal governments, private parties and the public in general. This basically prevents the EPA and the Army Corps of Engineers from implementing the WOTUS rule in all 50 states.
