Washington DC – Congressman Ted Yoho (R-FL-03) was pleased with the passage of the Farmers Undertake Environmental Land Stewardship Act (FUELS). The FUELS Act – which Congressman Yoho co-sponsored – modifies the Environmental Protection Agency’s (EPA) burdensome farm fuel storage regulation. The rule has negatively impacted farmers throughout Florida. Congressman Yoho gave the following statement:
“Unnecessary regulations like these are choking our economy. I have said that some regulations are necessary, but rules that stand in the way of farmers and all hard working Americans – trying to make a living – are wrong and should be deleted from the registry. Government needs to help not hinder business and encourage growth. The FUELS Act will do just that.”
The FUELS Act will ease the Spill Prevention, Control, and Countermeasure (SPCC) program rules for small farmers and ranchers by modifying the exemption level to be more reflective of a producer’s spill risk and financial resources. The exemption level for a single aboveground container would be adjusted upward to 10,000 gallons while the aggregate level on a production facility would move to 42,000 gallons. In addition it places a greater degree of responsibility on the farmer or rancher to self-certify compliance, instead of having to procure the services of certified Professional Engineers (PEs).
